TKEY-POOL (Tkeycoin pool)

We are completing the work and debugging of the official pool for Tkeycoin, this is a completely new approach for mining Tkeycoin. The pool will feature higher performance and stable architecture, a light interface, and objective commissions.

Libra cryptocurrency users face taxing problem

Facebook and its partners hope that consumers and businesses across the world will spend money in a new cryptocurrency – Libra. However, users of Libra seem likely to face a potential tax charge and additional tax compliance, which could be both costly and inconvenient. It is not clear how Facebook intend to solve this problem.
The basket of currencies behind it means currency gains will be taxable.
What’s the problem?
The Libra White Paper says that Libra will be fully backed by a reserve comprising bank deposits and short-term government securities in a range of traditional fiat currencies. Because the reserve will be effectively backed by a basket of fiat currencies, the exchange rate of Libra against any particular fiat currency (e.g. the Libra/GBP rate) will inevitably fluctuate as those underlying fiat currencies fluctuate.
This creates a novel problem for users of Libra: each time they transact using Libra, they’ll be making a currency gain or loss in their local fiat currency. In most countries those currency gains will be taxable. Those users will need to pay any tax due and may need to file a detailed tax return showing all their transactions and the exchange rate at the time. Unless this problem is somehow solved, this seems to us to be a significant barrier to wide adoption of Libra.
Why is this different to other cryptocurrencies?
Gains and losses on cryptocurrencies are taxable in almost all countries. However, whether early adopters of Bitcoin (and other decentralised cryptocurrencies) have actually paid the tax due is a different question. While some cryptocurrency exchanges are now reporting account-holders to tax authorities, many still are not.
Libra is very different. Instead of adopting the decentralised model of Bitcoin and other cryptocurrencies, the Libra Blockchain will be governed by the “Libra Association”, a not-for-profit organisation made up of a range of businesses including Facebook, MasterCard, Visa, Stripe and PayPal among others. This means that unlike Bitcoin (and others), for Libra there will be a ‘central authority’ with oversight over users’ transactions. Our strong expectation is that tax authorities will require the Libra Association to report on its users’ transactions, either under existing tax reporting laws or under new legislation.
For this reason, users probably won’t be able to ignore the tax treatment of Libra.

How will the tax work?
If Libra rises in value (relative to the user’s home fiat currency) between the time a user acquires Libra and the time they spend it, then they will have made a gain which most countries will tax. On the other hand, if Libra falls in value, the user will have made a loss which they may be able to set against any Libra gains made in that tax year. This will generally be the case regardless of whether the user is actually making a gain or loss in economic terms.
Users will therefore have to track the point that they acquire Libra, the point at which they spend it, and the exchange rate relative to their home fiat currency each time. If the overall result across a tax year is positive, tax will have to be paid.
For a typical UK consumer, the compliance will often be more painful than the actual tax (given the UK’s generous £12,000 annual allowance for tax-free capital gains). For consumers in other countries, actual tax liabilities are much more likely (as France, Germany and others have much more limited, or zero, annual allowances).
This seems to us a big problem for Libra to solve. How many users will be willing to deal with all this complexity and the risk of a tax charge?
What are the potential answers?
  1. a) A political solution: Libra could lobby governments and tax authorities to create a special exemption from tax on Libra gains and losses. This seems to be Facebook’s intention. However, given the political and regulatory difficulties Facebook are already facing in relation to Libra, and the fact this would seem to open the door to tax-free gains on other cryptocurrencies (which tax authorities will doubtless resist), the chances of this seem remote.
  2. b) A tech solution:Automatic tax calculation and reporting systems could be integrated into Libra wallets to make the process as straightforward as possible for users and tax authorities. But the prospect of an unexpected tax bill at the end of the year will still be off-putting to many consumers. And this would highlight to users the relative advantage of transacting in local fiat currency instead of Libra.
  3. c) A market solution: Don’t operate Libra in countries where the tax treatment for consumers is awkward (or, alternatively, operate it, but don’t expect large scale take-up). This seems contrary to Libra’s stated goals.
  4. d) A more fundamental solution: Change Libra so that, instead of being a new currency, it is essentially an e-wallet system. A UK consumer spends £50 to buy £50 of Libra, and spends pounds in UK stores; a French consumer spends €50 to buy €50 of Libra, and spends euros in Eurozone stores; and so on. The tax complexities would largely disappear, but this would be a significant reversal from what has been announced.
Finding a solution which meets both Libra’s apparent aspirations and the needs of its intended users does not appear to be straightforward. If Libra is to launch in 2020 as expected, the Libra Association will need to move quickly to solve these issues in order to ensure that it delivers the seamless experience users have come to expect from Facebook and its other founding members.

Cryptocurrency markets challenges and solutions

This has been bugging me for a while so thank you for endulging my rambling. TL;DR at the end.
I'd like for everyone to just think about what we're trying to do here. Don't forget what the ultimate goal is. Anyone remember? Is it to make a profit? No, that's a secondary goal. The primary goal is to develop widespread adoption of cryptocurrency as an alternative to fiat currency. Anyone remember this lofty goal or did we all forget this while chasing 30% daily price swings. We're trying to complete with USD, GBP, EUR, and CNY, remember?
This is EUR vs. USD. You'll note that this is all data (or click on "All" button on the bottom), going back to 1993 through today. What do you notice? You'll notice an open of $1.22 to €1. After a few months, it fell about 10%, then rose up 24% over the next two years only to drop about 40% over seven years and then almost doubling over eight years only to drop about a third in the last ten years to where it is today - almost where we were 25 years ago (approximately).
This is BTC vs. USD. You'll note that this is all data going back to 2011. During the last seven years it has... oh my God are you kidding me?! This is LTC vs. USD.
Let's not forget what we're talking about. We're talking about currency. For currency to be used, it needs to be relatively stable. Now compare the charts above. Let's say we created a new country called Cryptonia. Which of these would you like to use as currency? EUR? BTC? LTC? My money is on EUR. Why? Because it's relatively stable.
Now let's fast forward a bit and pretend that Cryptonia has adopted Litecoin as its official currency. Our largest trading partner is the US. How would transactions between merchants work in this scenario, taking into account the last few days. I'll use the following prices:

This works both ways as far as you can do the math in USD vs. LTC to see how this screws over at least one party due to the wild price swings. Note: fiat currency does the same thing with one key difference explained later on.
Don't forget that this is all within 3 days. Now sure, obviously the last few days isn't something that happens every day ... but doesn't it? Look at the examples of EUR:USD. Any sharp spikes or drops have taken months to execute - enough time for relative prices to adjust. Look at cryptocurrency prices - the swings (from a percentage basis) are wild on a regular basis. In short, cryptocurrency isn't acting like currency. It's acting like an asset and not just an asset but a highly speculative one. The IRS is right to treat it like an asset because if it looks like an asset, and it acts like an asset, then it is an asset.
Where do I believe this should go? I believe cryptocurrency market needs to mature. I believe these drastic price swings need to stop. When will this happen? I believe it'll happen when the cryptocurrency market reaches a happy plateau where the market cap has reached a point where the buyers and sellers mostly eliminate one another and the relatively large price swings - from a percent point of view - are as boring as Mr. Stein. EUR vs. USD went up 0.03% today. 0.03%. In LTC-speek, that's going up $0.58 for the whole day. Oh and it was a wild ride too. Why it went all the way down to $1.21697 and all the way up to 1.22645. I know, I know - tie me down because I'm out of control.
Is this the only problem? No. Cryptocurrency has another problem and that's the sheer number of types of coins available. How many coins are available? 1,448. Nearly 1,500 coins all competing with each other for market share. We have Bitcoin at about $200b all the way to something like Digital Money Bits (DMB, an appropriate acronym). What is it? Who cares, it's worth $3,832. Not $3.832 billion or million but literally $3,832 with a volume of $35,509 today and hey, just this June, its market cap reached an all time high of $62,000! You missed the recent run-up though and boy did you miss it. On January 1st, its market cap was worth almost five hundred dollars! Yep, about two Litecoins! But look at it now - it went from $500 market cap to $3,832 in less than three weeks. Clearly this one is shooting to the moon.
This is a problem. Decentralization has an unfortunate side effect of - duh - nobody being in charge. There's no real clearance for these and some people with a little bit of money can literally copy and paste a whitepaper and have this chart and have a serious valuation of almost $17b from $140 million in literally 30 days. This doesn't act like a currency either. This is a problem.
Don't forget, this isn't like the dot-com era. We're not launching IPO's and .com companies that have different ideas. Amazon isn't like Ebay, or Google, or Yahoo, or Facebook or anything else. They all have different ideas for different segments of the population. We are in the cryptocurrency market. The world today has 180 fiat currencies. Cryptocurrency market is approaching 1,500. We need to trim the fat and the outright forgeries. Market cap isn't enough to weed them out. There needs to be something, a stabilizing force, that should act as a clearinghouse for launch of new cryptocurrencies. The market has failed to destroy shitcoins. Heck, it rewarded them based on lies, paid endorsements, FOMO, and FUD for other coins. This doesn't help the cryptocurrency market. It helps a few people get really wealthy really quickly and you are left holding the bag, so to speak. Should coins only be allowed to be introduced when its network reaches a certain hash rate? Isn't that the only objective point of value we have - number of mathematical calculations and power used in those calculations? You can't fake that.
What's another problem with cryptocurrency? It's what it represents. The governments don't see crypto as a positive force. After all, it directly competes with their own currencies. Can the governments shut this down? No - this is the Internet, after all. But they can kill it in other ways. I don't know how many people here remember but my first brush with Bitcoin was the ransomware viruses which wanted $300 in Bitcoin to unlock files. Bitcoin was seen as something tied to illegal activities. If governments - and let's say the US, South Korea, and China in particular - ban Bitcoin and cryptocurrencies in particular then what they'll really do is make transactions illegal. What's the on-ramp and off-ramp to/from crypto? The banks which are already regulated. Now let's say you're in the US, your bank account is tied to your Coinbase account and you have some cryptocurrency. US issues a regulation which states that trading cryptocurrency is now illegal. It issues orders to all US banks to shut down related accounts. The following things will happen: cryptocurrency prices will tank and everyone is going to scramble taking money out which would likely overload the system, causing massive delays.
But let's say you're left holding your crypto and it's been a month. What can you do with it? Not much. Crypto isn't accepted in enough places yet. You can continue holding, hoping the price and ability to extract will come back one day. After all, you can't get your money back. Your bank closed your related account. You can open another one at any new bank but they'll either ban you from connecting your account to Coinbase or they'll confiscate any money coming from Coinbase and charge you with a crime. Now have the governments banned crypto? No - you can use and trade crypto all you want since it can't be traced. But have they effectively? Yes. Ironically, it's the banks that'll save us and I think that's why Ripple blew up. After all, if you have a cryptocurrency that sucks the bank's [censored] and plays along, you can get:
I think that's why something like Ripple blew up - because it doesn't care much about regular people, it wants to be the speedy highway for bank<->bank transfers.
What's a solution to this problem? More regulation and playing nice with the governments. Crypto isn't going mainstream if you shut out all governments. It needs to be connected. This means working with regulators to make sure that KYC laws are followed, that people report and pay money on any gains, and that - to a point - there's some supervision and tracing of transactions in a way that if you're robbed, you can get your money back. This will create a new job field, which - considering our current growth - will create a whole slew of high-paying white-collar jobs. Considering the high-level of transactions, banks would start this, followed by private companies, governments, and law-enforcement agencies. A good way to start this is what CBOE and CME have started to do - legitimize the currency. This is a foot in the door to the real holy grail: FOREX markets. When it's legitimized and not in serious competition with governments, it'll be embraced and its availability - along with instant transfers and low fees - will be widely supported by serious platforms.
Until these problems are fixed, the cryptocurrency market will remain what it is today: a speculative asset and not a currency. During the time it's taken me to write this post, Litecoin has gone up 2.6%. Euro remains at 0.03% gain.

In part 3 I will now discuss Cryptocurrency valuations, price metrics and identifying coins of value, worth holding.

What makes a coin worth holding: The value proposition
What makes anything worth holding? How much of themselves is a person willing to put into it - that's how much.
Cryptocurrency is largely driven by faith. It is a speculative enterprise i.e. people mostly put money into cryptocurrencies believing they will go up in value in the future; their plan to sell at a higher price when it does.
Currently most cryptocurrencies serve no function than being currencies in themselves. Unfortunately these currencies are largely not recognised by governments, most institutional investors or companies are legitimate stores of value or legitimate currencies of transaction. As such legislation and rules around the world regarding them vary considerably and are often absent.
There are very few cryptocurrencies that have legitimised backing, are insured or supported by enterprises that are insured for their loss and essentially there is little to protect you if you lose money through them.
So why do people bother putting money into cryptocurrencies it in the first place?
If the present and future value of a cryptocurrency is driven purely by speculation then you are essentially gambling by putting your money to buy that coin and joining the pool of other gamblers who are doing so. You are essentially joining a ponzi scheme and waiting game hoping you've gotten in early enough and convinced enough people to buy more of the asset you hold at slightly higher prices until a price is reached that you can cash out at (or until that thing becomes so big that everyone starts using it as their store of value).
This type of dynamic essentially underpins the mentality of most investments and trades i.e. buy low and sell high. I'd like to add buy early for investors since buying during a low in an already established asset may be setting yourself up for being forced to sell at a lower low later (especially if you don't understand the fundamentals of that asset).
If however the present or future value of a cryptocurrency is driven by some service other than speculation which can attract and drive fiat currency into it's ecosystem then it is potentially valuable.
I.e. will people actually use their USD/Yuan/Euro/GBP/Yen/INR etc to actually purchase the coin in question to do something useful with it (other than gamble on it's future price).
There are some cryptocurrencies which satisfy this criteria:

Bitcoin
It is not a currency, it is a remittance system and store of value. It has a reputation increasingly to being seen as a digital version of gold.
Bitcoin has the cultural and historical advantage of being the first cryptocurrency. It is also still the largest cryptocurrency by a long way with the largest marketcap i.e. price per bitcoin [$952 as of writing] x the number of bitcoin in circulation [16,074,687] which is $15.3 billion. Compare to it's next biggest competitor Ethereum which has a marketcap of $700 million (i.e. only 4.57% of Bitcoin's).
Bitcoin's value proposition is that it is a store of value. It may not be able to sustain this without significant upgrades to it's underlying software.

Monero (XMR)
Bitcoin does not have anonymity inherently built into it's software. Therefore if you buy and sell Bitcoin especially on cryptocurrency exchanges (where user registration is required), it is possible to trace whom Bitcoin is being transferred from and to.
For this reason I see Monero as Bitcoin + anonymity. I.e. it's value proposition is as store of hidden wealth. I also believe it does not have the issues that bitcoin does namely, same level of mainstream recognition, spotlight of regulatory awareness and developers do seem to be more focused on achieving better scalability and transaction times (it already does 10-20 minute verification time vs bitcoins 1 hour) which gives it better potential as a currency presently compared to Bitcoin.
-This sort of market cap dwarfs gold. However this type of up-scaled usability will not occur until the transaction verification times are much faster (nanoseconds) and the protocol is enhanced to cope with much larger transactions volumes and frequency at that speed; We are a long way off that.
I do believe fiat stored in Bitcoin will gradually transfer into Monero boosting it's value. I am not sure Monero though can presently bring fresh fiat currency (USD, Yuan etc) into it's ecosystem beyond outsider speculation in future price.
It is not unique in it's function or potential value proposition. My warning about holding Monerofor the long term is that it has competition for it's function not just from Bitcoin itself but from other anonymous coins such as Zcash, DASH (which provides instantaneous settlement) and SDC. Perhaps more importantly, Ethereum (ETH) is now planning to implement optional anonymity (via zSNARKs) in it's transaction network; if it does when combined with Ethereum's own functionality and well defined development roadmap (that will likely several second verification times in late 2017) would render XMR potentially redundant.

Ethereum (ETH)
The value proposition for Ethereum is that it allows for complex, trustless settlement systems to be built on it. This is a huge deal because the scope of applications is wide and although the technology needs to mature (to support greater transaction volume, frequency and more secure functionality) the sheer amount of fiat such a platform could attract through conversion of traditional centralised settlement and contract services to more secure decentralised platforms is very huge.

Shadowcash (SDC)
The value proposition is a double escrow, fully anonymous, decentralised privacy platform which incorporates private chat, private marketplace and secure, trustless private settlement system into one platform that is fully integrated into it's own blockchain.
Shadowcash already has multiple features that make it an excellent store of value: Low coin supply, potential for great demand, near instantaneous transaction verification times, ability to earn interest for simply holding it.

In summary I think Shadowcash can be a very useful application as a privacy platform for private communications and transactions.

Summary lessons
The first rule in investing or trading in a given cryptocoin is deciding if it has a value proposition:
1. *Can it draw fiat currency (USD, Euro, Yuan etc) in such a way as to give it a valuation that is fully independent of pure speculation?* 2. *Is it unique?* 3. *Is it rare?* A limited supply with a low or negative inflation rate will lead to increasing price as demand goes up. 4. Are there significant risks associated with the value proposition? 
In the next article I will cover lesson 3b: Price metrics and valuations. It will be much shorter I promise but equally informative and we will cover topics such as price determination, impact of speculation, price manipulation, whales and their impact and the impact of bitcoin on the entire cryptocurrency ecosystem.

My view for the worst, better, best case scenario

Even with current straight bankruptcy (hasan) trustee can address the court based on finance analysis and cuncil for new evaluations of intangible assets(btc) due to price violity and significant asset value increase after inital btc value evaluation, what if approved, with current straight bankrupty btc+forks must be sold to pay all creditors with updated and new evaluated claims. On another hand, only if CR and plan is approved, these btc and forks can be distributed unexchanged (unliquidated) to the creditors.
All asset whatever tangible or not is liquidated only to the certain point to get liquid asset (funds) to pay all creditors. When that is done, bankruptcy is completed and court/trustee authority stops. Any remaining asset remain as asset what company can use to resume busines or whatever they choose. Ordinary, in bankruptcy liquidation, all asset in full had to be liquidated, because creditors claims are much higher then company assets worth. Its liqidated in full only if asset can't be sold partialy and there is no other assets to be liquidated. However, in MtGox bankruptcy things has changed, untangible asset are now worth much more then total of approved creditors claims and if claims stays with current evaluation, asset will be liquidated only to the funds worth what equal all total approved creditor claims, nothing more! Update: under bankruptcy (hasan) corporation has to be dissolved what after distribution of all creditors has been made and Court bankruptcy termination order , dissolution esentualy cause all remaining asset liquidation and surplus sent to the shareholders - Tibanne and then Mark Karpeles.
Worst case scenario: The Court settle all creditors claim with current evaluated btc (483$) +fiat+interst coverted and paid as JPY where only enough intangible assets (btc) are liquidated (sold) to settle all creditors (what are almost already done), what makes bunkruptcy completed and reamining 165k btc and forks remain as Mtgox intangible asset where they can do whatever they want, liquidate and pay dividends, trade with btc, invest in other projects etc (bankruptcy is over, no obligation or liabilities to MtGox creditors). (Unfortunetly, in my opinion, this will most likely be the case. Read edit at the end of the OP).
Update: under bankruptcy (hasan) corporation has to be dissolved what after distribution of all creditors has been made and Court bankruptcy termination order , dissolution esentualy cause all remaining asset liquidation and surplus sent to the shareholders - Tibanne and then Mark Karpeles.
Better scenario: If some miracle (never) happens the Court accept new btc evaluation, but then these to be paid as JPY, all (or better to say) suficient remaining btc need to be sold(liquidate) to settle new evaluated creditor claims and question is how much liquid asset (funds) creditors would receive due crushing the btc price. Eventual btc+forks surplus(°) what would be quite lower then in worst case scenario, would remain as intangible MtGox asset where corporation can do whatever they want - bankruptcy is completed. (°(eventual btc+forks surplus would depend on new btc price evaluation for creditor claims and difference in new total claimed sum vs. funds JPY what trustee get from actual btc liquidation). Update: corporate dissolution aplies here too, just much less funds to be sent to the shareholders.
Best scenario: (Low probability, read edit at end of the OP) Civil rehabilitation under supervision with approved plan where creditors can claim all remaining btc+ forks unexchanged (not liquidated) + what is already been liquidated.
In this case, if plan is approved we would get 100% our current claim. We need to divide total claimed JPY sum with 50.058JPY (btc 483$) to get how much that is as btc base and on that result add aprox 17% of btc/bcc distributed as btc/bcc. Percentage (17%) might be lower, depend on ther lawsuit and non mtgox users creditor claims. Example of the best case scenario: Current approved claim. Rates to JPY (2014) BTC= 50,058.12 JPY; US$ = 1USD=103.64 JPY Currency US$ balance = 1,200$= approved sum JPY=124,368. Bitcoin balance = 14btc = approved JPY = 700,813.68 124,368+700,813.68 =825,181.68 JPY total of approved creditor claim/ that is sum what creditor receive 100% sum (liquid funds almost available, to be distributed as JPY). 825,181.68/50,058.12=> 16.48 BTC base: 16.48x17%=> 2.80 BTC and 2.80 BCC to return as cryptocurrency. Sumarise: Creditor receive 825,181.68 JPY and 2.80 btc and 2.80 bcc. That would be max return. Same calculation is aplied if creditor had only btc balances, only any currency (fiat) or both currency(fiat) and btc. Both fiat or currency mean: USD, EUR, GBP, JPY etc.
Iam not sure what that actual CR and plan are in the "best case scenario" as I have no details. We actually need sort of "better case scenario" just without required to liquidate remaining btc+forks and to be distributed as intangible asset (btc+forks). Beside, its Trustee duty to look best interest of all creditors, but for bankrupt company as well, what might cause conflict. Its defenetelly hard and complex situation, for all parties.
Questionable is whatever liquidated intangible asset (btc) under bankruptcy (straight or CR) are subjected to the capital gain (not dividend) and approprate income tax what would cause lower(dilution) funds distribution. However, in that case question is how would be regarded our creditor claims i.e. deductable as intangible asset value entry? Capital gain/profit- loss - deductable - expense=> corporate gross income - tax=> net income. So actually, from what I know from accounting practise, paid funds for evaluated claims would be asset (btc) "in value" while liquidated asset "out value" so actual capital gain net from btc are: difference in paid claims minus actal liquidation value! Beside, that "net capital gain" are not actually "net gain" as there are minus from other deductable sums and only when they are substracted make net income before corporate income tax! It maight be discharged, but I doubt it. Only liquidated untangible asset (btc) are regarded as corporation capital gain/profit, its not corporation dividends. Its conflicted situation because MtGox did not bought these btc, nor mined them, nor gifted, nor received as Mtgox investment and they were never corporation assets. Control of btc as intangible assets does not always equal propietorship (if there are contract or mutual agreement), but it will be (are) if not chalanged and Iam not sure on what grounds are we creditors then (unless corporation addmited debt/liability, but then again on what terms and conditions or user agreement these btc have been received?). Regardless, Trustee must have profesional finance advisoaccountant.
Some examples of intangible assets: patents, trademarks, franchises, goodwill, copyrights, Internet domain names, performance events, licensing agreements, service contracts, computer software, blueprints, manuscripts, joint ventures, medical records, permits, and trade secrets and many more. When MtGox were alive, such intangible asset doesn't enter finance balance sheet neither as asset value or liability value. It would if MtGox exchanged them (trade) for his account with buy/sell price. MtGox when alive these btc just had to record in secundary books as btc +/- held analiticaly for each user. Under bankruptcy proceedings, such a intangible assets as bitcoin is very hard to assest (evaluate), usualy trustee waits until last minute bankrupt company to liquidate them or best bid (°) and to update btc evaluation value what prior were blank, in order creditors get as much as possible. In our case, trustee did not do that and I have not found anything what would make him to evaluate at start of the filling the claims. (°)Actually I think, in case of public auction certain restriction might apply, certain party can't bid (I might be wrong).
However, not all asset are in the same category. In my country, bitcoin is regarded as financial asset, it does not matter is it tangible or not. If I as a person or the company make money from trading internet domains, it would be regarded as income subject to the tax. But if I as a person (not company) make money from exchanging certain personal financial assets, btc, any currency, diamonds, gemstone, gold and earn (dividends and interest excluded) from the positive rate difference, it would not be income subjected to income tax. But in same situation, company would be subjected to the taxes. Capital gain has two separate catogory, dividends what is profit on top of asset (asset reamin) and capital gain from the trade of asset, where one asset is exchanged to another asset and profit is from the rate difference, which can be either positive either negative.
There was a lawsuit against bankrupt Mtgox where user requested full btc refund what were denied with this explanation:
Presiding Judge Masumi Kurachi said the Civil Code envisages proprietorship for tangible entities that occupy space and allow for exclusive control over them. The judge said it is evident bitcoins do not possess the properties of tangible entities...
Basicly that mean, bitcoin is intangible where envisaged proprietorship can't be claimed as they are not phisical in nature and because Mtgox had exclusive control!(based on Japan civil code btw what is 120 years old (°), but what about corrporation/commerce law?) Beside, whatever is exclusive control of said bitcoin (intangible asset) depend on mutual contract, user agreement, term and conditions. Regardless, it was right Court call in this case, they just couldn't return full btc holdings, no chance whasoever, it would be a nightmire for the rest of users who doesn't follow his step, but if he accepted loss of aprox 3/4 btc and wanted only remaining 1/4 rulling might be different.
(°) The National Diet approved significant amendment to the Civil Code in May 2017 to update the Civil Code which is approximately 120 years old. Some general rules and many provisions regarding contracts were amended. The amended Civil Code will be enacted sometime before June 2020.
Edit: Our btc and any other currency balances held at MtGox with 2014 market value is our claim against mtgox all assets. BTC belong to the Mtgox -we creditors only claim that debt. Even these BTC are sold at higher rate then 2014. this just make raise in value of the mtgox liquid financial asset (while intangible asset btc exit books), but doesn't automaticly raise mtgox debts to us! Debt stays as is. According to the mtgoxlegal lawyer, new claim evaluation is not possible and I agree. Then how we the creditors, even in CR will be able to claim the btc as they dont belong to us as btc, but only current debt? Its like we sold our btc at 2014. at 483$ to the Mtgox who never paid us and that value we claim now within our claims. Try to imagine how btc dont exist or it exist but with same rate in 2018 as in 2014. We would be in the same situation if JPY rate against all other currency went to the roof, but btc are still at around 500$. Like its not in 2014, 1usd=103 JPY, but let say in 2018, 1usd=100,000 JPY, our claims would still reflect 2014 rates (even in CR) btc are not different. Even if CR reopen the window for filling claims and evaluation of the ALL claims, it would be at 2014. market rates!
I have a idea where we could get something over our current claims, but still brainstorming and many users won't like it as that is not what they expect to get. I think we are fucked - worst case scenario. Even if someone try to sue based on btc balances once held at Mtgox, it would fail. It might be different case, if Mark(•) said before bankruptcy, hey, these btc never belonged to the Mtgox, return what is left after audit to the mtgox users and then start bankruptcy to try get what went missing from real owned mtgox asset, what is not much and beside, I think bankruptcy would be terminated on grounds how mtgox asset can't even cover administrative creditors who have priority, let alone other creditors. (•) (All three insolvency proceedings can be filed either voluntarily or involuntarily. Generally, no one, including a debtor or any of its creditors, is obligated to file a petition to commence insolvency proceedings under Japanese law.).
50k JPY per bitcoin from creditors approved claim from 2014. is not binding because of Mtgox online claim system state it (or offline claim signiture), but its final and binding based on the Japan Bankruptcy Act court rulling and applicible as binding contractual Agreement in any other Japan proceeding, or eglible laws, Civil Rehabilitation included. Beside, that is only one reason, other reason is how Mtgox is in the bankruptcy proceeding since 2014. its never completed, eventual civil rehabilitation is only transition and if it ever commence, Mtgox is still under rehabilitation Act where for creditors claim total on 2014 rates total nothing change, but can increase distribution from the debtor profits max 100% claim total value (Mtgox has already enough funds or asset to sell to cover 100% payout). Third reason is how Mtgox users are regarded as last class unprotected non-priority creditors. And more reasons, but you get the picture! There is not much difference for the last class of creditors (Mtgox users) between liquidation or civil rehabilitation.
Due to Mtgox terms of use and accounting, Mtgox users are something as unsecured none-priority trade creditors without right to retain proprietorship of sold/bought, but unpaid btc (goods) until actual user withdraw. Real IN and OUT for both fiat and bitcoin with Mtgox are deposits and withdraw, trading are all just virtual balancing and Mtgox is in bankruptcy since 2014. without activity for creditors in regard on this IN and OUT (or trade). Otherwise, if we had legal grounds to get Mtgox btc asset surplus, we would get portion of non-stolen bitcoin back long time ago either outside of bankruptcy or within as separate satisfaction and with that portion btc back, would be able to claim damages for the missing bitcoins.
Anybody can (sponsor) buy MtGox capital (surplus included) and negotiate ~2000-3000$ per bitcoin where sponsor would need ~400-500M$ fresh capital (to take surplus and liabilities) and for that need civil rehabilitation, but nothing change for the creditor claims value (50k JPY/BTC), sponsor is still obligated only creditors claim total value and when settled, sponsor can use surplus free, fresh as their choice. If sponsor is a (group) of creditors, from that ~400-500M$ their claim total on 2014 rates is deducted. Bitcoins balances can't be segretated, otherwise creditors would have it long time ago.
Be careful who use you (creditor) to send umbiguous letters to their lawyers, surveys, without really knowing concrete and detailed plan and what is creditor benefit and how and on what legal grounds they plan to achive it, don't accept diplomatic responses! If somebody want to be a sponsor, I accept it, its a busines, but if nothing change to my creditor claim value with concrete plan how to achive it, it would just further delay distribution! Then its sponsor benefit, not ALL creditors benefit, even though might look like it! Read Bankruptcy and Rehabitilation Acts to learn about trustee duties and responsibilities and how Mtgox trustee have no say in this, trustee only follow court issued order.
Its not only this binding claim value a problem! If we had legal grounds on surplus btc assets, we would be secured creditors and would get portion of non-stolen bitcoin back long time ago either outside of bankruptcy or within, as separate satisfaction and with that portion btc back, would be able to claim damages for the missing bitcoins. I just don't understand people who spent $100k-200k for lawyers blind trust where lawyers just ensure them to think how CR somehow make Mtgox users what are last unsecured non-prority class of creditors into secured creditors with preserved propetorship of Mtgox bitcoin balances, who can claim bitcoin seperatelly either as btc or liquidated value and who could not claim that in the bankruptcy liquidation, but somehow magically in Civil Rehabilitation they can! Based on what legal grounds? Group lawyer told them how would need an court precedent in order creditors get above of 2014 rates claim value!? Precedent? If Mtgox users had agreemant what state how all balances (btc and fiat) are preserved propietorship until user withdraw, we would have aprox 1/4 btc long time ago and no precedent is required for that, (I could tell them this for free).
MtGox case were true Caveat Emptor. Finally, we all bought and sold bitcoin what was not actually fully unspent at Mtgox bitcoin wallets and users monetary balances did not reflect fully MtGox bank account balances.
04/22. I tried to discuss at mtgoxlegal group about counter-arguments what would overturn this major problems in order to help group lawyers, even we end up with nothing, but many misunderstund and bombarded me with questions to defend this and insulted me personaly, because some are ignorant, arrogant, rude, on ego trip and missed the the point how I must post problems first in order to discuss about valid arguments to overturn it, otherwise they would not understand what I talk about. They asked me even to prove it??? Imagine ignorance! Creditor situation is already funded within Japan bankruptcy and Rehabilitation Acts, Civil and Corporate Code, but I have to prove it to them! OMG, that all I can say on that. Wrong group to discuss obviously!
Even by some magic CR commence (if Tibanne appeal fail), it does not mean creditors get anything above of already approved claim total based on 2014 rates, unless Mtgox trustee state it so and rehabitilation plan is confirmed within 5 months after commencement.

What makes a coin worth holding: The value proposition
 
What makes anything worth holding? How much of themselves is a person willing to put into it - that's how much.
Cryptocurrency is largely driven by faith. It is a speculative enterprise i.e. people mostly put money into cryptocurrencies believing they will go up in value in the future; their plan to sell at a higher price when it does.
Currently most cryptocurrencies serve no function than being currencies in themselves. Unfortunately these currencies are largely not recognised by governments, most institutional investors or companies are legitimate stores of value or legitimate currencies of transaction. As such legislation and rules around the world regarding them vary considerably and are often absent.
There are very few cryptocurrencies that have legitimised backing, are insured or supported by enterprises that are insured for their loss and essentially there is little to protect you if you lose money through them.
 
So why do people bother putting money into cryptocurrencies it in the first place?
 
 
If the present and future value of a cryptocurrency is driven purely by speculation then you are essentially gambling by putting your money to buy that coin and joining the pool of other gamblers who are doing so. You are essentially joining a ponzi scheme and waiting game hoping you've gotten in early enough and convinced enough people to buy more of the asset you hold at slightly higher prices until a price is reached that you can cash out at (or until that thing becomes so big that everyone starts using it as their store of value).
 
This type of dynamic essentially underpins the mentality of most investments and trades i.e. buy low and sell high. I'd like to add buy early for investors since buying during a low in an already established asset may be setting yourself up for being forced to sell at a lower low later (especially if you don't understand the fundamentals of that asset).
 
If however the present or future value of a cryptocurrency is driven by some service other than speculation which can attract and drive fiat currency into it's ecosystem then it is potentially valuable.
 
I.e. will people actually use their USD/Yuan/Euro/GBP/Yen/INR etc to actually purchase the coin in question to do something useful with it (other than gamble on it's future price).

Bitcoin
It is not a currency, it is a remittance system and store of value. It has a reputation increasingly to being seen as a digital version of gold.
 
 
 
 
 
Bitcoin has the cultural and historical advantage of being the first cryptocurrency. It is also still the largest cryptocurrency by a long way with the largest marketcap i.e. price per bitcoin [$952 as of writing] x the number of bitcoin in circulation [16,074,687] which is $15.3 billion. Compare to it's next biggest competitor Ethereum which has a marketcap of $700 million (i.e. only 4.57% of Bitcoin's).
 
 
 
 
Bitcoin's value proposition is that it is a store of value. It may not be able to sustain this without significant upgrades to it's underlying software.

Monero (XMR)
Bitcoin does not have anonymity inherently built into it's software. Therefore if you buy and sell Bitcoin especially on cryptocurrency exchanges (where user registration is required), it is possible to trace whom Bitcoin is being transferred from and to.
 
 
For this reason I see Monero as Bitcoin + anonymity. I.e. it's value proposition is as store of hidden wealth. I also believe it does not have the issues that bitcoin does namely, same level of mainstream recognition, spotlight of regulatory awareness and developers do seem to be more focused on achieving better scalability and transaction times (it already does 10-20 minute verification time vs bitcoins 1 hour) which gives it better potential as a currency presently compared to Bitcoin.

Particl is incredibly easy to use and is heavily focused on usability. This is absolutely essential to it's end users: customers who seek convenient easy and speedy secure anonymous transaction. This will be a dream come true for traditional users of darknet markets.
 
To explain why lets elaborate on traditional darknet markets where in order to transact anonymously you have to:
1. Download the TOR browser. 2. Learn how to use it. 3. Buy XMR or Bitcoin. 4. Learn how to transact with these coins *safely* (yes this is still an issue with XMR in spite of it's built in privacy). 5. Learn how to and where to find reliable secure darknet markets. 6. Create accounts on these markets to access them *and* 7. Have faith that the websites and the highly centralised (and thus much more vulnerable) servers hosting those markets you use will not get shut down, not disappear with your money and not betray your transaction details and potentially identities to the authorities should they be infiltrated by them. 
Whereas with Particl's market place this process will become:
1. Download the Particl client. 2. Buy some PART on an exchange and transfer it to your Umbra client. 3. Browse the Particl marketplace and transact securely, safely and anonymously. 
 
 
In summary I think Particl can be a very useful application as a privacy platform for private communications and transactions.

1. *Can it draw fiat currency (USD, Euro, Yuan etc) in such a way as to give it a valuation that is fully independent of pure speculation?* 2. *Is it unique?* 3. *Is it rare?* A limited supply with a low or negative inflation rate will lead to increasing price as demand goes up. 4. Are there significant risks associated with the value proposition?

Obelisk SC-1 miner profitability - how long could they last?

Hey, my friends! As some of you here have too, I've ordered an Obelisk SC-1.
I'm considering colocation in a storage facility, which is in my case will cost the equivalent to $62/month if I pay for a whole year pre-paid. I'm just wondering if these miners will be profitable for a whole year? I've calculated that 150.000 SC with a price of $0.01 per SC would mean $1500 the first month, which obviously is an amazing profit margin. But how fast could this rate stagnate?
I'm in a position where I wouldn't have to pay for electricity costs of running the miner if I shipped it to myself. Therefore wondering if not having to deal with the noise of the miner at home/fear of miner breaking down or catching fire while traveling is worth the $62/month (including power) to keep it safe and running in a storage unit.
So say 10 months into mining; how dramatic of a mining reward stagnation could one expect? Is 1/10 of what you'd get the first month plausible?

[Request] PUBG Chinese hacker profits

One of the main reasons there are so many hackers in Playerunknown's Battlegrounds is that the currency earned by playing can be indirectly converted to real cash. I would like to find an estimate for the average profit per week of this method for the hackers.
Info: There is a flat rate of 800BP(In-game currency) per solo win. Every solo kill is rewarded with another 20BP Every 5 points of damage is also rewarded with 1BP, on top of the kill reward.
The starting price of a random crate is 700BP, then 1400, 2800, 4200, 5600, 7200. After the sixth crate the price of every crate after that is the previous crate +1400 BP.
The chance for getting crates are as follows (these chances may change in future patches): Suvivor crate: 10% Wanderer crate: 10% Biker crate: 20% Desperato: 20% Militia crate: 40%
Here are the current Steam market prices for the crates(with a 5% steam market transaction fee, so the seller lose 5% of the following listed price with minimum 1 pence fee) (also sorry all prices in GBP): Wanderer: ~£0.36 Suvivor: ~£0.28 Desperato: ~£0.05 Biker: ~£0.46 Militia: ~£0.93
The militia crate is fairly new and the market equilibrium price does not seem to be set yet. May edit the price if it falls significantly.
After selling the crates and receiving steam wallet funds, the hacker could use various websites or already be part of an organization that sells and trades other steam market products (main example being CSGO skin trading and betting sites) to convert his/her funds into PayPal/Bitcoin, or cash.
Assumptions(you may change these if you want but they are made to make the math a bit less impossible): There is only one hacker per game.
The hacker wins every game he plays.
Each game with a hacker will last between ~20-30 minutes.
In each game the hacker will get ~20-30 kills.
The hacker will play as if he is working a full time job.
Source: various Google searches since I stopped playing PUBG a few weeks ago, and heard from friends about the massive influx of hackers, wanted to know if you could actually make a living playing/hacking PUBG in China.
This is a long, nasty calculation, and I'm sure the answer will be a very rough estimate, so props to anyone who does give this one a crack.

Hi again. This is the third part in our ongoing series on how to trade better and determine intelligent investments in cryptocurrency for the future.
In part 3 I will now discuss Cryptocurrency valuations, price metrics and identifying coins of value, worth holding.

What makes a coin worth holding: The value proposition
What makes anything worth holding? How much of themselves is a person willing to put into it - that's how much.
Cryptocurrency is largely driven by faith. It is a speculative enterprise i.e. people mostly put money into cryptocurrencies believing they will go up in value in the future; their plan to sell at a higher price when it does.
Currently most cryptocurrencies serve no function than being currencies in themselves. Unfortunately these currencies are largely not recognised by governments, most institutional investors or companies are legitimate stores of value or legitimate currencies of transaction. As such legislation and rules around the world regarding them vary considerably and are often absent.
There are very few cryptocurrencies that have legitimised backing, are insured or supported by enterprises that are insured for their loss and essentially there is little to protect you if you lose money through them.
So why do people bother putting money into cryptocurrencies it in the first place?
If the present and future value of a cryptocurrency is driven purely by speculation then you are essentially gambling by putting your money to buy that coin and joining the pool of other gamblers who are doing so. You are essentially joining a ponzi scheme and waiting game hoping you've gotten in early enough and convinced enough people to buy more of the asset you hold at slightly higher prices until a price is reached that you can cash out at (or until that thing becomes so big that everyone starts using it as their store of value).
This type of dynamic essentially underpins the mentality of most investments and trades i.e. buy low and sell high. I'd like to add buy early for investors since buying during a low in an already established asset may be setting yourself up for being forced to sell at a lower low later (especially if you don't understand the fundamentals of that asset).
If however the present or future value of a cryptocurrency is driven by some service other than speculation which can attract and drive fiat currency into it's ecosystem then it is potentially valuable.
I.e. will people actually use their USD/Yuan/Euro/GBP/Yen/INR etc to actually purchase the coin in question to do something useful with it (other than gamble on it's future price).
There are some cryptocurrencies which satisfy this criteria:

Bitcoin
It is not a currency, it is a remittance system and store of value. It has a reputation increasingly to being seen as a digital version of gold.
Bitcoin has the cultural and historical advantage of being the first cryptocurrency. It is also still the largest cryptocurrency by a long way with the largest marketcap i.e. price per bitcoin [$952 as of writing] x the number of bitcoin in circulation [16,074,687] which is $15.3 billion. Compare to it's next biggest competitor Ethereum which has a marketcap of $700 million (i.e. only 4.57% of Bitcoin's).
Bitcoin's value proposition is that it is a store of value. It may not be able to sustain this without significant upgrades to it's underlying software.

Monero (XMR)
Bitcoin does not have anonymity inherently built into it's software. Therefore if you buy and sell Bitcoin especially on cryptocurrency exchanges (where user registration is required), it is possible to trace whom Bitcoin is being transferred from and to.
For this reason I see Monero as Bitcoin + anonymity. I.e. it's value proposition is as store of hidden wealth. I also believe it does not have the issues that bitcoin does namely, same level of mainstream recognition, spotlight of regulatory awareness and developers do seem to be more focused on achieving better scalability and transaction times (it already does 10-20 minute verification time vs bitcoins 1 hour) which gives it better potential as a currency presently compared to Bitcoin.
-This sort of market cap dwarfs gold. However this type of up-scaled usability will not occur until the transaction verification times are much faster (nanoseconds) and the protocol is enhanced to cope with much larger transactions volumes and frequency at that speed; We are a long way off that.
I do believe fiat stored in Bitcoin will gradually transfer into Monero boosting it's value. I am not sure Monero though can presently bring fresh fiat currency (USD, Yuan etc) into it's ecosystem beyond outsider speculation in future price.
It is not unique in it's function or potential value proposition. My warning about holding Monerofor the long term is that it has competition for it's function not just from Bitcoin itself but from other anonymous coins such as Zcash, DASH (which provides instantaneous settlement) and SDC. Perhaps more importantly, Ethereum (ETH) is now planning to implement optional anonymity (via zSNARKs) in it's transaction network; if it does when combined with Ethereum's own functionality and well defined development roadmap (that will likely several second verification times in late 2017) would render XMR potentially redundant.

Ethereum (ETH)
The value proposition for Ethereum is that it allows for complex, trustless settlement systems to be built on it. This is a huge deal because the scope of applications is wide and although the technology needs to mature (to support greater transaction volume, frequency and more secure functionality) the sheer amount of fiat such a platform could attract through conversion of traditional centralised settlement and contract services to more secure decentralised platforms is very huge.

Shadowcash (SDC)
The value proposition is a double escrow, fully anonymous, decentralised privacy platform which incorporates private chat, private marketplace and secure, trustless private settlement system into one platform that is fully integrated into it's own blockchain.
Shadowcash already has multiple features that make it an excellent store of value: Low coin supply, potential for great demand, near instantaneous transaction verification times, ability to earn interest for simply holding it.
